Transgender, Non-Binary, and Gender Questioning Pupils Policy

This is a model policy designed for schools and colleges in England to adapt for their own use. We have tried to ensure that this policy is in line with the law of England & Wales. However, we are not lawyers and cannot guarantee that we have correctly interpreted the law. If you are unsure, you should seek independent legal advice. This policy only covers pupils, and is restricted to how trans+ pupils are supported in school. It does not cover staff, and nor does it cover wider trans issues such as the PSHE curriculum, or how LGBT+ equality is promoted in a school setting.

As trans & non-binary educators, we have developed this policy in line with our approach of empowering and supporting pupils to explore and develop their identities in their own time and free from outside influence. We believe that the best interests of the pupil must always be the primary concern.

We have made use of government guidance (specifically Keeping Children Safe in Education 2026) and the Cass Review in developing this policy. While we have significant concerns with the content of some of these documents, we recognise that schools will wish to take them into account. In the case of KCSIE, the guidance is statutory and so schools are required to implement the guidance unless they have a good reason to take a different approach.
